Title IX & Gender Equity Reviews
Title IX is the
law, while gender equity is the philosophy behind the law. Alden &
Associates, Inc. is pleased to assist colleges and universities
with this important component of their intercollegiate athletics
programs.
A good review
will do several things. First, it can serve, if done correctly, to
be an educational opportunity for the campus and athletics staff
to learn more about Title IX and gender equity. It also can
highlight the positive things that have occurred in the past with
both the men's and women's intercollegiate sport programs.
Finally, the review will make recommendations for any needed
changes that must take place for full compliance with Title IX.
Title IX
reviews are conducted on the campus of the client institution. It
requires the consultant to come on campus for a complete review of
the current athletics program. This is a good time for the
consultant to meet with specified college or university employees,
review athletics facilities and offices, gather materials, and
generally understand the campus climate at it relates to
intercollegiate athletics and gender equity.
In reviewing the
materials and interview responses, Alden & Associates, Inc. will
seek to ascertain the responses to The Three-Part Test as
determined by the Department of Education's Office of Civil
Rights:
Part I:
Whether intercollegiate level
participation opportunities for male and female students are
provided in numbers substantially proportionate to their
respective enrollments; or
Part II:
Where the members of one sex
have been and are underrepresented among intercollegiate athletes,
whether the institution can show a history and continuing practice
of program expansion which is demonstrably responsive to the
developing interests and abilities of the members of that sex; or
Part III:
Where the members of one sex are
underrepresented among intercollegiate athletes, and the
institution cannot show a history and continuing practice of
program expansion, as described above, whether it can be
demonstrated that the interests and abilities of the members of
that sex have been fully and effectively accommodated by the
present program.
It is from The Three-Part Test that
further review is conducted. Sharing information from an
institution's Equity in Athletics Disclosure Act (EADA), including
the worksheets information, would be relevant to this process.
It is
also important, particularly for NCAA Division I institutions, to
note that this review can be the preliminary review prior to the
NCAA Division I Athletics Certification process (Cycle I or Cycle
II). By following the information from the self-study instrument,
a good analysis can be performed. Also, an institutional plan
would be a part of the recommendations in the final report as
issued by the consultants.
